Chapter 2.52 DESIGN REVIEW BOARD

There is created a design review board in and for the city. (Prior code § 3-155)
- 2.52.020 Composition.
The design review board shall consist of at least one (1) group composed of five (5) members each. (Ord. 5535 § 1, 2006: Ord. 5425 § 1, 2004: Ord. 5347 § 1, 2003: prior code § 3-156)
- 2.52.030 Appointment-Compensation.
Members of the design review board shall serve without compensation and shall be appointed by a majority of the council. (Prior code § 3-157)
- 2.52.040 Qualifications.
At least one (1) member of each design review board group shall be a licensed architect. Other members of the board shall be persons who, as a result of their training, experience and attainments are qualified to analyze and interpret architectural and site planning information, including, but not limited to, licensed landscape architects, urban planners, engineers and builders/developers. Each member of the design review board shall be a qualified elector of the city at the time of appointment and during incumbency. - 2.52.050 Terms of office.
Terms of office for members of the design review board shall be four (4) years or until their successors shall be appointed and qualified. The term of each design review board member shall be coterminous with the term of the council member that nominates that member to the design review board. (Ord. 5604 § 1, 2008: prior code § 3-159)
- 2.52.060 Vacancies.
Vacancies for any unexpired term of membership in the design review board shall be filled by appointment as provided in the Section 2.52.050. (Prior code § 3-160)
- 2.52.070 Removal of members.
Any member of the design review board may be removed by a majority vote of the council when, in the discretion of the council, the best interests of the city will be served. (Prior code § 3-161)
- 2.52.080 Chairperson--Chairperson pro tempore.
Each design review board shall select one of its members as chairperson of the board. In the case of the absence of the chairperson, the members present at any meeting shall select one of their number to act as chairperson pro tempore. (Prior code § 3-162)
- 2.52.090 Meetings.
The design review boards shall meet as often as necessary to conduct its business at the time and place specified by resolution of the board. Special meetings may be convened as specified by the director of planning in accord with the provisions of the Ralph M. Brown Act of the state to dispose of any backlog or additional business. Any additional board appointed by the council shall meet at the discretion of the council. (Ord. 5347 § 3, 2003: prior code § 3-163)
- 2.52.100 Quorum--Voting.
Three members of the design review board shall constitute a quorum. Voting shall be viva voce. (Prior code § 3-164)
- 2.52.110 Minutes.
The director of planning shall be responsible for keeping a record of the voting and decision minutes of the proceedings. (Prior code § 3-165)
- 2.52.120 Powers and duties.
The design review board shall have the power and it shall be its duty to review, approve, disapprove and attach conditions to design plans and design review applications in accordance with the intent, purpose and standards for design review established pursuant to Chapter 30.47 of this code. The authority of the board shall be limited to only appearance, site planning, design and general layout. Upon approval of plans, no additional approvals are necessary from the design review board. The design review board shall not have the authority to require full working drawings. It shall be the duty of the director of planning or his or her designee to stamp plans approved by the board and to draft and sign all correspondence necessary for the execution of the duties and function of the board. - 2.52.130 Procedural rules.
The design review board may adopt, from time to time, such rules of procedure as it may deem necessary to properly exercise its powers and duties. All such rules shall be kept on file in the office of the director of planning, and a copy thereof shall be furnished to any person upon request. In all procedural matters and consideration not otherwise provided for in this chapter or in the rules of procedure, the proceedings of the board shall be governed under Robert's Rules of Order. All meetings of the design review board shall be open to the public, however, the design review board shall not hold public hearings. (Prior code § 3-167)
- 2.52.140 Cooperation of city officials.
All officers, divisions and division heads of the city shall cooperate and render all reasonable and necessary assistance to the design review board. (Prior code § 3-168)
- 2.52.150 Limitation on liability.
Neither the design review board nor any member thereof shall incur any financial liability in the name of the city. (Prior code § 3-169)
