Complaint Filed
On May 29, 2009, the City Attorney's Office filed a 14 count misdemeanor complaint against the property owner at 1808 Niodrara for various violations of the Municipal Code relating to an unpermitted structure. The owner received a Design Review Board exemption and building permit for a minor addition and interior remodel that the complaint alleges wholesale changes to the exterior of the house were made in substantial deviation from the approved plans, thereby exceeding the scope of the permit. The complaint was filed in the Glendale Superior Court, Case No. 9GN02139. Arraignment is set for June 30, 2009.

Gang Injunction
On March 18, 2009, the Honorable Maureen Duffy-Lewis issued a judgment granting the permanent injunction filed by the Glendale City Attorney's Office and the Los Angeles City Attorney's Office against the Toonerville Gang. The judgment includes, among other items, provisions prohibiting Toonerville gang members from being in Palmer Park and Chevy Chase Park. The injunction is designed to make it difficult for the Toonerville Gang and its members to engage in criminal and nuisance activities within the Los Angeles River-Glendale Safety Zone. The safety zone is a 4.5 square mile area within the Los Angeles Police Department's Northeast Division and the City of Glendale, as well as a 1.25 square mile area within the LAPD's Foothill Division.

Ovasapyan v. City of Glendale
On February 20 and 25, 2009, a U.S. District Court jury found for plaintiff, Edmond Ovasapyan, and against two police officers in a case involving the November 1, 2005 arrest of Ovasapyan for the murder of Christopher Shahnazari. The District Attorney’s office filed charges against Ovasapyan on November 4, 2005. After further investigation by the Glendale Police Department, including obtaining DNA testing which led to a suspect who ultimately confessed to the crime and exonerated Ovasapyan, the District Attorney’s office dismissed the case against Ovasapyan. The jury awarded Ovasapyan $1,160,000 in compensatory damages and $150,000 in punitive damages against the two defendant officers. The City Attorney’s office has filed post-trial motions asking that the verdict be set aside. The City will consider whether or not to appeal once the District Court has ruled upon the motions.

People v. ATNA Enterprises, et al - Case number 7GN04746
A jury trial was held from September 23, 2008 until October 1, 2008, concerning the misdemeanor charge of Glendale Municipal Code 30.12.020(F), for utilizing in excess of the 30% of the serving area for the purposes of a private party in a C-1 zone on June 15, 2007. The jury, following a three-day deliberation, rendered a verdict of acquittal in favor of the defendants for the charge alleged.

People v. Melkonyan, Abelian, Aivazian, Shamoyan, Torosyan, Case No. 8GN02656.
The Court found all defendants guilty, after trial, of violating Glendale Municipal Code, Section 9.20.165(a) for remaining at a City Park past 10:00 p.m. The Court ordered fines and penalty assessment in the amount of $235 as to each of the Defendants.

People v. Revo Art & Jazz Cafe, Inc.
On September 9, 2008, Defendant Revo Art & Jazz Cafe, Inc. entered a plea of no contest to the charge of conducting business without a Zoning Use Certificate (ZUC) in violation of Glendale Municipal Code, Section 30.46.020, and was sentenced to 24 months summary probation, payment of a total fine, penalties and penalty assessments exceeding $3200, and a specific court order that Defendant, as a condition of probation, shall not operate any businesses within the City of Glendale unless lawfully permitted and approved by the City to do so. Defendant has obtained all required final approvals for all permits required to operate the subject premises located at 1022 E. Chevy Chase, Unit # A, as a full service restaurant, absent alcohol sales until a Conditional Use Permit (CUP) is obtained for the same, the Court removed the previously issued cease and desist order to allow the premises to open as a full service restaurant-without alcohol sales.

People v. Gaguik Bagdassarian, Case # 8GN01335
Violation of GMC 8.36.070 - excessively barking dog on the premises. Defendant found guilty a bench trial. Court sentenced defendant to 36 months summary probation, total fine of $515, ordered the dog removed-removal order stayed if Defendant (1) within 10 days equips the dog with an anti-bark collar and (2) within 14 days enrolls himself and the dog in weekly behavior training. Court set a progress report for 9/18/08.

Shekerdemian v. City of Glendale
On Friday, June 13, 2008 a jury returned a verdict in favor of three Glendale Police Officers who were accused of using excessive force against Yeghia Shekerdemian. Shekerdemian claimed that the officers violently threw him to the ground during the course of arresting him and caused him serious injuries. The officers stated that they merely handcuffed Shekerdemian and seated him on the curb and that he suffered no injury. The jury agreed that the officers did not use excessive force. The Defendants will be seeking costs against Shekerdemian. Said costs could exceed $15,000.

Harmon v. City of Glendale
United States District Court Judge Florence Marie Cooper grants the City and its police officers summary judgment. Plaintiff brought a civil rights action in federal court for false arrest and malicious prosecution following an acquittal by a jury in the criminal trial. The court agreed with the City's position that probable cause existed for the arrest and that plaintiff failed to prove any prosecutorial misconduct by the police officers. This matter was handled by Deputy City Attorney Miah Yun.

A&M Tree Service - Court Hearing June 11, 2008
Artemio Acevedo, as owner, and A&M Tree Service both entered no contest pleas to trimming trees without permits. Mr. Acevedo was fined a total of $1,678.38 including penalty assessment. Since the corporation was suspended, no fine was imposed on them. Both were placed on 24 months summary probation on the terms and conditions that they not trim, cut, or prune trees without appropriate permits and city approvals. The matter was handled by Deputy City Attorney Dorine Martirosian.

City Awarded Costs - Sahakian v. Glendale, et al.
Following our trial victory in April 2008, on May 23, 2008, the Court awarded the City of Glendale and the four police officer defendants costs for defending the case in the amount of $10,253.26. This matter was defended by Ann Maurer, Sr. Asst. City Attorney and Miah Yun, Deputy City Attorney.

Complaint Filed Against A&M Tree Service Corp.
On May 5, 2008, the City Attorney's Office filed a seven count misdemeanor complaint against A&M Tree Service Corp., and other named principals in the company for various violations of the Municipal Code relating to the unlawful trimming of indigenous trees. The complaint was filed in the Glendale Superior Court, Case No. 8GN01753. Arraignment is set for May 28, 2008.

City Obtains Defense Verdict
April 25, 2008 - City obtains defense verdict in federal court matter. In Sahakian v. City of Glendale, et al., a federal court jury rendered a unanimous verdict in favor of the City and its police officers in a case alleging false arrest, excessive force, and malicious prosecution. The case was successfully defended by Senior Assistant City Attorney, Ann Maurer, and Deputy City Attorney, Miah Yun.

Update on Revo Cafe
At the April 14, 2008 arraignment, as a condition of releasing the defendants on their own recognizance, the City Attorney's Office requested and the Court ordered that release is on the condition that defendants cease and desist operation of Revo Art and Jazz Cafe, also known as De Revolution, pending trial.
